Judge Boots Pegasus’ Claims vs. DirecTV5/14/2004 6:15 AM Eastern
Pegasus Communications Corp. just can’t win in court against DirecTV Inc.
A federal district court judge Thursday granted DirecTV’s motions to eliminate all remaining claims against it by Pegasus and Golden Sky Systems Inc. in the parties’ four-year-old lawsuit.
This follows an April 14 ruling in which a federal jury awarded DirecTV $51.5 million in damages from Pegasus regarding a lawsuit Pegasus filed against the direct-broadcast satellite giant claiming that DirecTV breached a joint marketing contract.
And in January, the same federal court ruled that a proposed settlement agreement between DirecTV and certain members of the National Rural Telecommunications Cooperative was fair and granted final approval of the class-action settlement.
Neither of the previous decisions was affected by Thursday’s ruling.
“We are pleased with the court's ruling, eliminating Pegasus' remaining claims," DirecTV executive vice president of legal and business affairs Dan Fawcett said in a prepared statement. "Our position has been completely vindicated with regard to Pegasus' claims, all of which have been dismissed or decided in DirecTV's favor on the merits.”
